    Abstract
    Freedom ofspeechisafundamentalrightinmodernsocieties,and ithasparticular signifi ontothewellfunctioni ngoftheconstituti onaldemocratic process. This freedom ofspeech is essentialto thedevelopmentofhumanpersonality andeverypersonshouldbefreeinhisthoughtand conscience.On the otherhand, it is also essential for the development and functioningofdemocracy. BangladeshandUSAisademocraticcountryanditsconstituti oncontains theright tofreespeech.Inthispaper, firstIhavediscussedtheconceptandperspectiveof freedomofspeechandofdemocracy and theirplace in the Constitution.Then Ihave tried to sortoutthegroundson which restriction can be imposed upon freedom ofspeech andalsodiscussedtheirjustification.Finally,Ihave discussedtheeffectof restricti on upon Freedomofspeech and expression over DemocracyandcontemporaryconditionofBangladeshandUSA.Themainaim ofthispaperistoidentify thereasonablegroundsofrestrictionuponFreedom of speechandtheireffectsoverdemocracy
