Implementation of Legal Aid Act, 2000: Problems and Prospect.
Abstract
The Constitution of the People‟s Republic of Bangladesh 1972 has theoretically ensured access to justice, fair trial, rule of law, fundamental rights, human rights, equality before law, and equal protection of law. However, to provide legal aid services and ensuring access to justice the Legal Aid Services Act, 2000 was enacted in 2000. But due to financial crisis and ignorance of law, these protections have become a fake promise to the vast majority of the people. The study will evaluate the existing legal aid services of the country and the challenges faced by the service seekers and providers which may aid to ensure access to justice. Equal access to justice for the rich and the poor alike is prerequisite to the maintenance of the rule of law. But, the justice system through judicial adjudication is very costly and that cost has been the most difficult factor for the average people to get justice.If justice is not made accessible to subjects of society as a whole, the whole administration of justice indeed becomes meaningless. Bangladesh is poor country massed with thousands of problems. Although the State has initiated several steps to make justice accessible to the common people, but justice has not yet been accessible to a large number of people. The research paper mainly deals with the Implementation of Legal Aid Act, 2000: Problems and Prospect.
