    Abstract
This paper reviews evidence indicating that as it has been enforced so far, affirmative action has contributed negligibley to women‟s progress in the workplace, affirmative action can be modeled as a tax on employers whose female employment growth growth greater than the regulatory standard, The tax constraint will not be binding as we shall see, this may hely explain an affirmative action program that is generally ineffective for women, Women's right to positive discrimination is a legally recognised right in the Bangladesh Constitution. Different policies of the government as well stipulate positive discrimination of women. By virtue of the fact that there is large-scale discrimination against women in the society, laws ensured some additional advantages for women to make parity between the two sexes in the society. To implement the constitutional provisions different steps have been taken by the government but in reality the positive discrimination to be effectively applied, the change in the approach of the society is imperative. The present paper presents a complete picture of positive discrimination of women in Bangladeshi law. For that different affirmative steps taken by the Government of Bangladesh are examined. And also the role of judiciary has been highlighted
