Admissibility and Reliability of Digital Evidence in Criminal Trials: Challenges in The Modern Criminal Procedure System
Abstract
Digital evidence has become an increasingly important component of criminal investigation and judicial decision-making in modern
criminal justice systems. The rapid development of information technology, electronic communication, digital devices, and internet
based platforms has transformed both criminal activity and evidentiary practices. As a result, courts increasingly rely on electronic
records, digital communications, surveillance data, and forensic findings during criminal trials.
This research examines the admissibility and reliability of digital evidence in criminal trials and analyses the challenges faced by
modern criminal procedure systems in regulating electronic information. The study explores the legal principles governing
admissibility, including relevance, authenticity, integrity, legality of collection, and procedural fairness. It further investigates factors
influencing reliability such as manipulation, technical error, forensic limitations, chain of custody, and evidentiary preservation.
The research adopts a qualitative doctrinal legal research methodology based on analysis of legal principles, academic literature,
procedural standards, and scholarly discussion. Both primary and secondary legal sources were considered in developing the analysis.
The findings indicate that digital evidence provides significant benefits for criminal justice administration but also introduces complex
legal and procedural concerns. Reliability depends not only on technological capability but also on effective authentication
procedures, proper forensic examination, judicial oversight, and protection of procedural rights.
The study concludes that criminal procedure systems should strengthen evidentiary standards, improve institutional capacity, and
adapt legal frameworks to technological development in order to maintain fairness and public confidence in judicial outcomes.
