    Labour Welfare and Industrial Justice in Bangladesh: An Analysis of Contemporary Labour Legislation

    Abstract
    This comprehensive analysis examines the evolution, current framework, and implementation challenges of labour welfare and industrial justice in Bangladesh through the lens of contemporary labour legislation. Since the enactment of the Bangladesh Labour Act 2006 and its subsequent amendments, the country has made significant strides in legislative reform, culminating in the historic ratification of all 11 ILO fundamental conventions in 2025. However, a persistent gap remains between statutory protections and ground-level realities for Bangladesh's approximately 78 million workers, the majority of whom operate outside formal legal protections. This paper critically evaluates the BLA 2006's provisions on welfare, safety, wages, trade union rights, and dispute resolution mechanisms, analyzing compliance with ILO standards and identifying structural weaknesses in enforcement. Drawing on the tripartite framework of labour governance—state regulation, collective bargaining, and worker participation—the analysis argues that legislative progress, while necessary, remains insufficient without corresponding institutional capacity building, judicial reform, and democratization of workplace representation. The paper concludes with policy recommendations aimed at bridging the implementation gap and advancing a genuinely just industrial relations regime in Bangladesh.
