Public Interest Litigation in Bangladesh: Tool for Justice or Judicial Populism
Abstract
Judicial Ruling on Public Interest Litigation in Bangladesh: Evaluating Effective and
Pathways for Reform as it has developed in recent years marks a significant departure
from traditional judicial proceedings. Public interest litigation is constitutional
jurisprudence and it is based on necessity of public interest or infringement of public
rights. Public interest litigation protects fundamental rights of the society and provides
social justice to economically and socially disabled people. In recent years, PIL has begun
to emerge as a potent new force within the justice system of Bangladesh. Social and
political activists have expressed high levels of interest in the potential of this
phenomenon to bring about significant change in Bangladesh society. This study
examines the idea of social justice through public interest litigation and Judicial Ruling in
various judgments in Bangladesh.
